MASHADIRUL AL AHKAM / ADILLAH AL AHKAM AS AN EFFORT TO PRESERVE ORIGINALITY IN ISLAMIC LEGAL STUDIES
Abstract
This article examines the epistemological urgency of mashadirul al ahkam (sources of Islamic law) and adillah al ahkam (legal evidences) as a method to maintain the originality of Islamic legal studies amidst contemporary challenges such as legal hybridization, secular influences, and reductionist approaches. The main issues focus on how the classical source doctrine (Al-Qur'an, As-Sunnah, Ijma', Qiyas, and other secondary sources) can function as a filter for legal authenticity. This research aims to reconstruct the methodological framework of adillah to safeguard the originality of Islamic law without abandoning flexibility. Using a qualitative-normative approach with a library research design, data were collected from primary classical usul fiqh texts and contemporary studies (2020–2025). The results indicate that systematic application of mashadirul al ahkam and adillah al ahkam significantly strengthens the epistemological boundaries, prevents arbitrary legal distortion, and promotes ijtihad that remains faithful to the foundational sources. Moreover, integration of maqasid al-shariah reinforces originality without rigidity.
